Sitting in the passenger seat doesn’t rule out a federal drug charge. A recent sentencing in North Carolina shows how two traffic stops, two years apart, can merge into a single federal case ending in more than a decade in prison.
What the Two Stops Revealed
According to a DOJ press release, Duplin County deputies stopped a vehicle in March 2022 with a 50-year-old Sanford man in the front passenger seat. They found more than $15,000 in cash near his seat. After he resisted a search, deputies recovered more than a pound of cocaine and several ounces of fentanyl from him.
Two years later, Lee County deputies stopped another car with him in the same seat. A K-9 alert led to roughly a pound of fentanyl hidden in the engine bay.
Investigators tied both stops to a distribution operation supplied from Charlotte.
Why Drug Weight Drives the Sentence
Federal drug penalties are built around quantity. Cross a threshold, and a mandatory minimum applies. The judge generally can’t sentence below it.
The federal drug penalty thresholds for a first offense include:
- 500 grams or more of cocaine or 40 grams or more of fentanyl, which carries a five-year minimum
- 5 kilograms or more of cocaine or 400 grams or more of fentanyl, which carries a ten-year minimum
The conspiracy count here alleged amounts at the higher tier. A federal drug trafficking lawyer in Florida will often start by examining how the government reached its weight figures, because lab results, packaging, and double counting can all change the total.
How Conspiracy Expands the Numbers
A conspiracy charge carries the same penalties as the underlying offense. And a defendant can be held responsible for drugs others handled, as long as those amounts were reasonably foreseeable and within the scope of the agreement. That is how weight from multiple stops, sellers, and months can attach to one person.
Presence Is Not Possession
Sitting near contraband is different from possessing it. For a passenger, prosecutors usually need proof of knowledge and control, such as drugs on the person, incriminating statements, phone records, or fingerprints.
Here, drugs were recovered from the man himself during the first stop. That made the government’s job easier. Many passenger cases involve far less.

The Same Laws Apply in Florida
A highway stop by local deputies can become a federal case once the DEA or ATF takes an interest. From there, the weight, conspiracy, and possession issues above become the core of the work a federal drug trafficking lawyer does before trial or plea.
