For a driver under 21, an alcohol case rarely involves a single proceeding. The criminal charge is one piece. A separate license action, governed by a different statute with a far lower threshold, is already running in the background before anyone reaches a courtroom.

What Troopers Reported

Florida Highway Patrol reported that shortly before 3 a.m. on a Sunday in June, a trooper attempted to stop a black Audi heading northbound on Interstate 275 into Hillsborough County. The driver, identified as 19-year-old Kimberly Melissa Gutierrez of Plant City, weaved across lanes before the pursuit ended with a PIT maneuver. Troopers said the car caught fire after the crash and that multiple occupants were pulled from the vehicle. Gutierrez was taken to St. Joseph’s Hospital for medical clearance.

According to the arrest report, the car reached speeds above 120 mph on the Howard Frankland Bridge. A trooper described the smell of alcohol as overwhelming and noted red, bloodshot eyes and slurred speech. Gutierrez later acknowledged having five margaritas in Ybor City.

Under 21 Means Two Sets of Rules

Every driver in Florida is subject to the general DUI statute. Drivers under 21 face an additional layer. Under Florida Statute 322.2616, it is unlawful for a person under 21 to drive or be in actual physical control of a vehicle with a blood-alcohol or breath-alcohol level of 0.02 or higher, and that violation carries a six-month license suspension for a first offense, or one year if the driving privilege has previously been suspended under the same section. A refusal to submit to a lawful breath test brings a one-year suspension, or 18 months for a repeat refusal.

The practical effect surprises families constantly:

  • The threshold is 0.02, not 0.08
  • A single drink can put a young driver over that line
  • The suspension can attach whether or not a criminal charge sticks
  • Zero tolerance and standard DUI exposure can arise from the same night
  • The department may not impose suspensions under both sections for the same episode
