Client was charged with DUI and facing up to 180 days jail. He was stopped for failing to maintain a single lane while driving.
In his police report, the officer said he smelled an odor of alcohol on our client’s breath and demanded that he/she submit to Road Side Field Sobriety Tests. Our Client agreed and has some trouble doing the tests because he was tired. Our client did not submit to a Breathalyzer.
Ben successfully argued to a Jury that our client was not too impaired to drive his car. He was tired and unfamiliar with the roads, which is what caused him to weave out of the lane of travel and have difficulty with the Road tests. The Jury did not find him guilty of DUI of alcohol.
