United States v. HP

Client was charged in the Federal Court of the Middle District of Florida with selling firearms to a prohibited person and selling firearms without a Federal Firearms License (FFL). Client accidentally sold a firearm to a convicted felon who was prohibited from owning a firearm. Client also failed to obtain an FFL when selling his guns at a gun show.

Our Client was facing 2 to 3 years federal prison. Ben successfully argued to the Judge that our client was not familiar with the FFL laws and that was why he committed the crimes. The U.S. Attorney’s Office argued that he should serve 3 years federal prison.

The Judge ruled in Client’s favor and sentenced client to probation. Avoiding incarceration allowed our client to keep his home, maintain his employment, and continue raising his child.
